Edward Fernandez Lawsuit: 20 Pending FINRA Arbitration Claims
According to BrokerCheck, customers have filed 20 FINRA arbitration claims involving Fernandez since May 2025. All 20 are pending, all arose while he was registered with Capulent, and all involve real estate securities. Together, the claims seek more than $5 million in alleged damages, and several do not state a specific amount.
The claims generally allege that Fernandez recommended unsuitable Delaware Statutory Trust (DST) investments and did not adequately disclose risks tied to the sponsor, the structure, or the properties. Fernandez denies the allegations in each dispute. No findings of wrongdoing have been made.
Versity and Crew DSTs Named in the Complaints
The investments named on Fernandez’s BrokerCheck report include:
- Vintage DST, named in at least eight disputes
- Hayworth Tanglewood DST
- 4th and J DST
- Wolf Run DST
- Inspire on 22nd DST
- Tailor Lofts DST
- Versity Income Property Notes, LLC
These offerings were sponsored by Versity Investments, now known as Crew Enterprises, and its predecessor Nelson Brothers. Many Versity and Crew DSTs have suspended distributions, and the sponsor’s principals face a lender lawsuit alleging the misappropriation of investor funds.

Fernandez’s DST Sponsor Business
Fernandez discloses two investment-related outside businesses. He is the owner of 1031 Crowdfunding, LLC, which he describes as a 1031 exchange sales business. He is also the manager of 1031 CF Properties, LLC, a DST sponsor that acquires and manages properties. According to his disclosure, some of its DSTs may be offered through Capulent.
A broker who also runs a DST sponsor may have a built-in conflict when recommending DSTs. Brokerage firms are expected to watch that conflict closely.
Employment History and Other Disclosures
Fernandez has been registered with Capulent since October 2017. He was previously registered with Boustead Securities, BrokerBank Securities, Stephen A. Kohn & Associates, Pacific Cornerstone Capital, and H&R Block Financial Advisors. FINRA expelled BrokerBank Securities in 2023.
His report also lists a 1994 misdemeanor conviction in Orange County, California, unrelated to the securities industry.

Frequently Asked Questions
How do I file a claim to recover money I invested through Edward Fernandez?
You file a claim against the brokerage firm, and you can name the broker too. Most brokerage account agreements include a pre-dispute arbitration clause, so claims like the 20 against Fernandez usually go through FINRA arbitration rather than court. Arbitration can still result in a monetary award.
What is an unsuitable DST recommendation?
A recommendation is unsuitable when the investment doesn’t fit your age, goals, risk tolerance, or need for access to your money. DSTs are illiquid, often carry high fees, and depend on a single sponsor, so they can be a poor fit for retirees or anyone who needs steady income they can count on.
Can Capulent be held responsible for my losses?
Yes, it can. Brokerage firms must investigate the private placements their brokers sell and must supervise those brokers. A firm that missed red flags at the sponsor or let a broker concentrate clients in one sponsor’s DSTs may be liable for failing to supervise.
