Apex Clearing Corporation Fined $250,000 Over Margin Account Supervision
FINRA accepted a Letter of Acceptance, Waiver and Consent (AWC) from Apex dated November 3, 2026. According to the AWC, from January 2020 through January 2023 Apex lacked a supervisory system reasonably designed to combine all of a retail customer’s margin accounts when checking that customer’s compliance with margin rules. FINRA found that Apex violated FINRA Rules 3110 and 2010. Apex agreed to a censure and the $250,000 fine without admitting or denying the findings.
Who Is Apex Clearing Corporation?
Apex Clearing Corporation is a Dallas-based clearing firm and a FINRA member since 1983. It settles trades, holds customer assets and extends margin loans for customers of other brokerage firms, many of them app-based investing platforms. Because of that setup, many investors have accounts carried by Apex without knowing it.
What FINRA Alleges Apex Did Wrong
Federal Reserve Regulation T and FINRA Rule 4210 require a clearing firm to add up a customer’s margin positions across all accounts introduced through the same brokerage firm. FINRA alleges that Apex reviewed each margin account on its own instead. As a result, Apex allegedly could not tell whether a customer trading actively across several accounts during the day had hit margin limits in total. A restriction Apex placed on one account also did not automatically carry over to that customer’s other accounts.
The AWC gives these figures for January 2020 through June 2022:
- More than 270,000 introduced retail customers held multiple margin accounts, about 712,000 accounts in total.
- About 61,000 of those customers carried margin balances across roughly 152,000 accounts.
- About 18,000 customers with balances had three or more margin accounts, including 130 people with ten or more.
How Apex Changed Its Margin Monitoring
After FINRA’s exam, Apex began blocking customers from opening multiple margin accounts in mid-2022. By January 2023 it was combining customers’ positions for margin purposes, and it later moved customers to a master account with subaccounts. The AWC does not say how many customers, if any, went past margin limits because of the gap.
Recovering Losses in an Account Cleared by Apex
A clearing firm plays a narrower role than the brokerage firm that opens your account and makes recommendations. That affects who may be responsible for your losses. If you lost money through margin calls, forced liquidations, excessive margin borrowing or other problems in an account carried by Apex, a claim may involve your introducing firm, Apex, or both, depending on the facts. The White Law Group can review your account statements and explain your options through FINRA arbitration.

Frequently Asked Questions About Apex Clearing Corporation
Most investors pursue recovery through FINRA arbitration rather than a court lawsuit. Most brokerage account agreements include a pre-dispute arbitration clause, which many retail investors don’t know they signed, so claims usually go to FINRA’s arbitration forum. Arbitration can still end in a monetary award or settlement, and an attorney can help identify which firms to name.
