LRT Hardeeville Multifamily 1 DST Lawsuit & Investor Concerns

The White Law Group is investigating LRT Hardeeville Multifamily 1 DST, a new $21 million Delaware statutory trust offering land near Hilton Head Island, South Carolina, to 1031 exchange investors. Here is what the filing shows and what investors considering a lawsuit or FINRA arbitration claim should know.

What Is LRT Hardeeville Multifamily 1 DST?

LRT Hardeeville Multifamily 1 DST is a Delaware statutory trust formed in 2026 and based in Charlotte, North Carolina.  According to AltsWire, the trust holds about 17 acres of undeveloped land in Hardeeville, next to Coastal Carolina Hospital, ground-leased for 50 years on a triple-net basis. A 216-unit apartment community is purportedly planned for the site, subject to financing and approvals. Trade press reports this is sponsor LRT Company’s fifth ground-leased DST.

LRT Hardeeville Multifamily 1 DST Offering Terms

The trust filed its Form D in August 2026. It reports these terms:

  • Exemption: Rule 506(c) of Regulation D
  • Securities offered: beneficial interests in a Delaware statutory trust
  • Total offering: $21,000,000
  • Amount sold: none reported at the time of filing
  • Minimum investment: $100,000
  • Estimated sales commissions: $1,995,000

The only selling firm on the filing is Metric Financial, LLC, which is authorized to sell in all states. The estimated commissions equal 9.5% of the offering.

The Affiliate Land Sale

The Form D estimates that $19,005,000 of the offering proceeds will go to people or companies related to the trust. It explains that about $18,795,000 “will be gained by an affiliate of the issuer in connection with its sale of the land to the trust which gain is attributable to the execution of the ground lease.”

Broker Due Diligence Obligations

A firm selling this DST must look closely at the affiliate land sale, the value of the land without the ground lease and who will pay the rent. It must also understand how the apartment project will be financed and built. Brokers then have to decide whether a 50-year land investment fits each customer’s age, finances and need for cash.

Risks of Ground-Leased Development DSTs

Investors own land, not a finished apartment complex, and their income depends on a ground lease being paid for decades. The project still needs financing and approvals, so delays or changes could affect the party paying the rent. DST interests have no public market, investors have no say in management, and 1031 tax benefits can be at risk if the trust runs into trouble.

This is LRT Company’s second DST at the Island Gateway development, following LRT Hardeeville Senior Living DST, a $17 million offering for land under a planned assisted living and memory care community.

Recovering LRT Hardeeville Multifamily 1 DST Losses

If a broker recommended this DST without explaining its risks and conflicts, or it did not fit your situation, you may be able to recover losses. Brokerage firms are responsible for their brokers’ recommendations and for vetting the products they sell. These claims are usually brought through FINRA arbitration.

Frequently Asked Questions

How do I file a claim to recover money I invested in LRT Hardeeville Multifamily 1 DST?

You file a claim against the brokerage firm that recommended the DST to you. Most brokerage account agreements typically include a pre-dispute arbitration clause, so these claims usually go through FINRA arbitration instead of court. Arbitration can still lead to a money recovery.

Why does the affiliate land sale matter to investors?

It means much of the offering money is tied to a sponsor affiliate’s profit on selling the land to the trust. Investors depend on the land and the ground lease being worth what they paid. A broker should explain that conflict before recommending the investment.

Can the brokerage firm that sold me this DST be held responsible for my losses?

Yes, a brokerage firm can be liable if its broker made an unsuitable recommendation or the firm failed to investigate the offering. Firms also have a duty to supervise how their brokers sell private placements. A large affiliate transaction is the kind of issue a firm’s due diligence should catch.
