Bradley Holts, World Capital Securities, Barred by Securities Regulator after Allegations

On February 27, 2023, the Securities and Exchange Commission (“SEC”) alleged that Bradley Morgan Holts, while registered as a broker in Denver, Colorado, misappropriated $186,382 from three elderly investor customers. Holts purportedly falsely told these investors that he would invest their money in securities of mutual funds offered by investment management firm Invesco Ltd.  Instead, Holts allegedly stole the investors’ money and used the money to pay personal expenses, including clothing, tanning salons, adult and dating websites, and a divorce lawyer.

The SEC alleged in the complaint that the three customers have never been repaid. The SEC further alleged that Holts’ misconduct was “intentional, repeated, and egregious, causing substantial losses to his elderly victims.”

The regulator is reportedly demanding a trial by jury, according to the complaint.

On July 28, 2021, the Financial Industry Regulatory Authority (FINRA), the self-regulator who oversees brokers and brokerage firms, reportedly barred Holts (CRD # 5819398) from the securities industry, according to a Letter of Acceptance, Waiver and Consent.

Failure to Supervise

All broker-dealers have a responsibility to adequately supervise its employees.  Brokerage firms that fail to monitor the business activities of their employees may be liable for investment losses. If your broker has defrauded you, you may be able to file a FINRA claim against your brokerage firm.

FINRA Rule 3110 (Supervision) requires a firm to establish and maintain a system to supervise the activities of its associated persons that is reasonably designed to achieve compliance with the applicable securities laws and regulations and FINRA rules.
Broker Investigation
The White Law Group is investigating potential securities claims involving World Capital Brokerage and its alleged failure to supervise broker Bradley Holts.

When brokers violate securities laws, such as making unauthorized trades or misappropriating funds, the brokerage firm they are working with may be liable for investment losses through FINRA Arbitration. FINRA arbitration is generally a faster and less expensive alternative to traditional litigation.

If your broker has defrauded you, you may be able to file a claim with FINRA to seek resolution through arbitration. FINRA arbitration can be a complex and technical process, and having an experienced attorney who is knowledgeable about securities law can greatly increase your chances of success.
