As reported in the Dallas Morning News, the Securities and Exchange Commission filed an emergency civil action against a Plano financier, alleging he was misleading clients, providing bogus statements and misappropriating funds.
The suit filed in Dallas federal court targets 2Randall Consulting Group Inc. and Brion Gary Randall. The suit alleges Randall, 47, operated an investing fund that put client money into AllianceBernstein LP mutual funds; the SEC says in its suit that Randall’s group does not have an account with AllianceBernstein.
Randall distributed bogus account statements and even distributed fake computer screen shots of online banking activity to clients, the suit alleges. The SEC has asked District Judge Reed O’Connor to freeze Randall’s assets and to appoint a receiver for the defendants. As many as six investors had given Randall $3 million combined to invest.
The SEC suit said that Randall previously had been a registered investment adviser, but he is not registered with any regulator.
The Financial Industry Regulatory Authority fined Randall $10,000 and suspended him for four months in 2005 for improperly managing customer accounts, the suit said.
Randall’s Web site touts his experience as a financial adviser and emphasizes that his investments aren’t risky; the site doesn’t note the fine or the penalty from FINRA, the SEC suit said.
Attempts to reach Randall and 2Randall Consulting by e-mail and phone calls to both the businesses and Randall’s Plano home were unsuccessful Friday. The number for Randall listed on the 2Randall Consulting Web site isn’t a working number.
